Article 1: These General Terms and Conditions (“Terms”) regulate the relationship between Hawk Minds Ltd. (“Provider”), owner of the online store https://tappcard.co (“Online Store”), and its users/customers (“Users”).

General Provisions

Article 3: The Online Store operates under these Terms.
Article 4: The Provider does not guarantee the continuous operation of the Online Store or error-free content.
Article 5: The Provider reserves the right to interrupt access to part or all of the Online Store without user consent, for an indefinite period, without liability for any resulting damages.
Article 6: The Provider reserves the right to change the structure and/or content of the Online Store without prior notice.

Changes under Articles 5 and 6 do not affect ordered and paid goods and do not impair the user’s right to receive them.

Characteristics and Use of the Online Store

Article 7: The main features of the services provided by the Provider through the Online Store are:
1. Viewing and sharing content.
2. Searching text content within the Online Store.
3. Posting content, comments, reviews, opinions, ratings, which the user allows the Provider to use, publish, and distribute.
4. Publishing content is subject to approval to comply with internet communication standards.

Article 8: Users can enter into sales contracts for products offered in the Online Store.

Article 9:
1. By accepting these Terms, the User and Provider agree that all statements regarding the conclusion and execution of sales contracts may be made electronically.
2. If users use the Online Store with registration, it is assumed that electronic statements made by them are from the persons indicated in the registration data.

Article 10:
1. Users can freely browse the Online Store without registration.
2. To use the Online Store with registration, the user must register and enter a username and password.
3. Users must provide accurate and up-to-date registration information.
4. Users explicitly declare that they are familiar with these Terms, agree with their content, and unconditionally comply with them.
5. Successful registration is confirmed via email.

Article 11: The Online Store lists the main characteristics of the offered goods.

Article 12:
1. The listed price for each product is final, including all taxes and fees, valid only at the time of publication.
2. Delivery cost is not included in the product price.

Conclusion of Sales Contract through the Online Store

Article 13:
1. Users use the Online Store to enter into sales contracts.
2. The contract is concluded in Bulgarian.
3. The user is a party to the contract based on the registration data.
4. The Online Store includes technical means for identifying and correcting information entry errors before concluding the sales contract.
5. The sales contract is concluded upon order confirmation by the Provider.
6. Users can order by contacting the Provider or using the Online Store system.
7. Users must provide accurate order details for billing and delivery.
8. Users can apply promo codes if available.
9. Users choose the delivery method and payment option.
10. The total amount and any additional fees are visible before completing the order.
11. Users agree to these Terms by marking the “I agree with the terms and conditions” checkbox.
12. Orders are completed by clicking the “Order” button.
13. Incomplete orders due to missing fields cannot be completed.

Article 14: The Provider is not responsible for undelivered orders if the user provides incorrect, incomplete, or inaccurate data, or if the delivery fails due to the courier’s fault.

Article 15: The Provider has the right to accept advance payment for sales contracts and delivery.

Withdrawal from Sales Contract

Article 16:
1. Users can withdraw from the sales contract within 14 days of receiving the goods without compensation or penalty.
2. The standard withdrawal form can be used.
3. Users must return the goods in the received condition without use.

Article 17:
1. If the user exercises the right to withdraw, the Provider must refund all received amounts within 14 days.
2. Additional delivery costs are not refunded unless the withdrawal occurred before the goods were shipped.
3. Users bear the cost of returning the goods.

Article 18: Non-compliance with the withdrawal conditions may result in refusal to accept the returned goods and non-refund of the paid amount.

Intellectual Property Rights

Article 19:
1. All information on the Online Store, including text, photos, audio, and video materials, is the Provider’s intellectual property or used legally.
2. The Provider retains all rights.
3. Use of the information without consent is prohibited.

Article 20: The Online Store may contain trademarks owned by the Provider or third parties, which require prior written consent for use.

Other Conditions

Article 21: The Provider falls under the jurisdiction of the Consumer Protection Commission and the Competition Protection Commission.

Article 22:
1. Information on the Online Store is for general guidance and does not constitute advice.
2. The Provider is not responsible for the accuracy or applicability of the information.
3. The Provider is not liable for damages from using the Online Store or its content.

Article 23: The invalidity of any provision does not invalidate the entire contract.

Article 24: These Terms are effective for all Users from 06.06.2024.

Article 25: The Provider can change the Terms at any time, effective upon publication.

Article 26: By using the Online Store, the user unconditionally agrees to these Terms and all subsequent changes.
